won in court again
well, in our neverending lawsuit story, we had another win today. i’ve posted so many times about this damn thing, it seems like it needs its own category, but i’m not gonna do it ;). The short back-story is that a real-estate agent didn’t give us proper notice to move out of our last house, and we got paid a settlement to get us to move out several months early. the real-estate agent has to pay that settlement amount to the old landlord, so now she’s trying to sue us to get us to pay her that settlement amount.
it’s gone through various incarnations, but basically the real-estate agent refuses to get proper legal advice, so today her case was thrown out. (she was trying to get the money by suing for “damages” to the house, but she doesn’t own the house so she can’t do that). Now, she’s trying another lawsuit, and we’ll have to go to a “settlement hearing” in august.
at some point, we’re going to have to figure out if it’s worth it to spend more money on the lawyers, or just pay her a portion of the money to make her go away. our hope is that we can just pay the lawyers and then get back our costs because the lawsuit is really dumb. who knows if the judge will make her pay the costs, though.
i guess the worst case is that i’ll have to shell out some mad cash to the lawyers, which will hit my year’s budget big-time, but i think it’ll still work out. It’s kinda ironic, though, that i realize this on the same day that the bank approved me for a line of credit ;)
